To open a foreclosure you will need to submit the following:
1. A cover letter from the attorney representing the foreclosing party.
2. Deed of Trust – Original recorded Deed of Trust with assignments or a certified copy of the recorded Deed of Trust or a copy of the recorded Deed of Trust and a certification prepared by a qualified lender.
3. Evidence of Debt – Original note with indorsements or a corporate surety bond 1 ½ times face amount or copy of note from qualified lender.
4. All assignments, merge documents, or name change documents necessary to track from the original beneficiary to the current beneficiary.
5. Original signed Notice of Election and Demand for Sale.
6. A Statement of the current owner and address.
7. A legible copy of statutes to be mailed with combined notice for every party on the mailing list (including the Public Trustee and the attorney).
8. Initial mailing list, which should include the Public Trustee and the attorney representing the foreclosing lienor.
9. Set of addressed envelopes for mailings with correct postage affixed and return address of the Public Trustee.
10. $500.00 deposit made payable to the Grand County Public Trustee.
Filings must also be made with the District Court to coincide with the Public Trustee's Office. Please check with them to determine their requirements. |
